KEJAKSAAN Negeri (Kejari) Pati, Rabu (19/8) menerima berkas dari Polda Jateng atas kasus terdakwa S (27), warga Pucakwangi Pati, yang diketahui menyebar foto bugil AS (25) yang juga pacarnya, sebagai korban.
Kasi Pidum Kejari Pati Firman Wahyu Octavian Jamus, Kamis (30/8) mengungkapkan, S didakwa melanggar Pasal 45 Ayat (1) Jo Pasal 27 Ayat (1) UU No 19 tahun 2016 tentang Informasi dan Transaksi Elektronik (ITE), atau Pasal 32 Jo Pasal 4 Ayat (1) tentang Pornografi.
Terdakwa, rencananya akan diarahkan ke pasal pornografi, karena terjerat dua pasal pilihan.
“Pasal 45 ayat 1 tentang Pornografi, ancaman hukumannya paling lama 12 tahun dan denda paling sedikit Rp 250 juta, paling tinggi Rp 6 miliar. Sedangkan UU No19 ayat 1 tentang ITE, ancamannya paling lama 6 tahun. Akan kita jerat dengan pasal pornografi. Meski pasalnya pilihan, tapi kami cenderung ke pasal pornografi,” kata Firman kepada media, Kamis (20/8).
Secara kronologis, Firman menjelaskan, awalnya terdakwa S berpacaran dengan korban AS. S yang seorang kuli bangunan, sebelumnya mengaku sebagai karyawan di perusahaan kepada AS, yang merupakan calon dokter.
Dengan modus pacaran dengan video call, S meminta AS telanjang, kemudian di screenshoot oleh S sebagai objek ancaman untuk melakukan penipuan.
Dengan modal foto bugil, S lantas mengancam AS akan menyebarkan foto bugilnya bila tak diberi sejumlah uang.
“Pertama diberi Rp 3 juta, setelah itu minta lagi. Korban tidak mau, terus diancam oleh terdakwa, kalau tidak memberi uang, foto bugilnya akan dikirim pada orang tuanya. Namun tidak digubris oleh korban. Akhirnya S nekat mengirim foto bugil ke orang tua dan kakak korban,” terang Firman. “Tak sampai di situ, foto itu juga dikirim ke Instagram, medsos-medsos terdakwa. Itu ada bukti di handphone-nya. Jadi, dari situ terekspos di Facebook,” imbuhnya.
Karena merasa dilecehkan, korban lantas melapor ke Polda Jateng agar mengusut kasus tersebut.
Firman mengatakan, saat ini S masih ditahan di Polres Pati, dan dalam waktu dekat, kasusnya akan disidangkan di pengadilan.***
