Magelang-Inspirasiline.com. Tim Kuasa hukum terdakwa Tan Giyanto yakni Fachri SH dan rekan menyatakan dakwaan terhadap kliennya atas dugaan pasal 372 dan 378 harus batal demi hukum. Hal ini disampaikan dalam sidang pembacaan eksepsi atau nota keberatan di Pengadilan Negeri Mungkid, Kabupaten Magelang, Jawa Tengah, Selasa (1/3/2022).
“Dalam eksepsi kami, perkaranya masuk wilayah perdata. Maka dakwaan harus batal demi hukum,” kata kuasa hukum Fachri,SH.
Dalam eksepsinya Tim Kuasa Hukum di depan majelis hakim, menjelaskan, bahwa perkara terdakwa TG masuk dalam wilayah perdata.
Menurutnya, terdakwa Tan Gijanto dengan saksi korban Hendi Kristianto telah melakukan kesepakatan kerjasama usaha dalam bidang suplay pasir di Depo Pasir Anugerah Pasir Mas, bahwa itu bukan milik saksi Nurul Huda akan tetapi milik Agung yang pengelolaannya dikuasakan oleh terdakwa.
Dikatakan bahwa surat dakwaan JPU antara satu dengan yang lainnya tidak berkesesuaian.“Kenapa jaksa yang satu dalam dakwaannya menyediakan mobil dengan cara membeli secara kredit tanpa uang muka. Dan dalam dakwaan penuntut umum menyatakan masing-masing membeli dengan uang muka,” terang Fachri.
Namun yang lain mengatakan bahwa terdakwa telah menjual 4 unit truk kepada orang lain, hal itu yang membuat perkara tidak jelas dan kabur.” jelasnya.
Menurutnya dakwaan terhadap perkara kliennya tidak memenuhi syarat formil, maka perkara tersebut harus batal demi hukum.
Terpisah, istri Tan Gijanto, Yani, berharap proses hukum suaminya berjalan seadil-adilnya. Yani yang mengikuti sidang perkara suaminya itu mengatakan bahwa suaminya merupakan tulang punggung keluarga. (jkw)
