Grobogan-Inspirasiline.com. Kasus dugaan tindak pidana korupsi yang dilakukan SES oknum Kades Jatipecaron Kec.Gubug Kab Grobogan dalam pengelolaan keuangan Pemdes Jatipecaron, Tahun Anggaran 2019 s/d 2021 memasuki tahap tuntutan.
Hal ini disampaikan Kasi Intelijen Kejari Grobogan Frengki Wibowo, SH., MH kepada media melalui siaran pers bernomor : B-47/ M.3.41 /PERS /08/2022.
“Surat tuntutan kepada terdakwa SES dibacakan oleh Iwan Nuzuardhi, SH Kasi Pidsus (Kepala Seksi Tindak Pidana Khusus) Kejari Grobogan selaku JPU (Jaksa Penuntut Umum) Kejari Grobogan di Pengadilan TIPIKOR Semarang ,” ujar Frengki, Senin (29/8/2022).
Sidang kata Frengki dihadiri oleh Majelis Hakim yang terdiri dari Ketua : Setyo Yoga Siswantoro, SH., MH, Anggota : Kandarwoko, SH., MH., Arif Noor, SH., MH., Panitera : Mas Mahmuda, SH, turut hadir Penasihat Hukum terdakwa : Iwan Udijanto, SH dan terdakwa SES dihadirkan secara online.
Frengki menjelaskan dalam tuntutannya Penuntut Umum menerangkan terdakwa terbukti secara sah dan meyakinkan bersalah melakukan Tindak Pidana Korupsi Secara berlanjut sebagaimana diatur dan diancam pidana dalam Dakwaan Primair yakni Pasal 2 ayat (1) juncto Pasal 18 Ayat (1) huruf b Undang-Undang Republik Indonesia Nomor 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi sebagaimana telah diubah dengan Undang-Undang Republik Indonesia Nomor 20 Tahun 2001 tentang Perubahan atas Undang-Undang Republik Indonesia Nomor 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi juncto Pasal 64 Ayat (1) KUHP.
“Penuntut Umum dalam amar Tuntutannya menjatuhkan pidana penjara kepada terdakwa selama 5 Tahun, pidana denda sebesar Rp.200.000.000,00 (dua ratus juta rupiah) dengan ketentuan apabila denda tersebut tidak dibayar diganti dengan pidana kurungan selama 4 Bulan, membayar uang pengganti sebesar Rp.437.184.086,00 (empat ratus tiga puluh tujuh juta seratus delapan puluh empat ribu delapan puluh enam rupiah),” jelasnya.
“Namun dalam hal ini terdakwa tidak membayar uang pengganti paling lama 1 bulan sesudah putusan pengadilan memperoleh kekuatan hukum tetap, maka harta bendanya dapat disita oleh Jaksa dan dilelang untuk menutupi uang pengganti atau dalam hal terdakwa tidak mempunyai harta benda yang mencukupi untuk membayar uang pengganti, maka dipidana penjara 2 Tahun dan 6 Bulan, membebankan kepada Terdakwa biaya perkara Rp.5.000,- (lima ribu rupiah),” lanjutnya.
Lebih lanjut Frengki mengungkapkan bahwa setelah dibacakan Surat Tuntutan, sidang ditutup dan akan dilanjutkan kembali pada hari Senin tanggal 05 September 2022 dengan agenda sidang berikutnya adalah Pledoi atau Pembelaan dari terdakwa atas Tuntutan Penuntut Umum.
“Sidang akan di lanjutkan lagi pada hari Senin tanggal 5 September 2022 mendatang,” tutupnya. ( jkwi)
